One of the most complex legal issues under GPLv2 is how far the copyleft or reciprocity requirement reaches to capture independent modules that are linked to or otherwise interoperate with GPLv2 code in a given software product or appliance. The continuing and sometimes heated debate over closed source loadable kernal modules indicates that there is still no consensus on the scope of reciprocity under GPLv2.
GPLv3 will ignite a new round of discussion and debate regarding reciprocity. Its drafters have adopted an entirely new and different approach to defining the scope of reciprocity and what is a "work based on the program" under GPLv3. Users and licensors who are considering GPLv3 will need to understand the new terms and how to apply them.
