If you distribute combinations of proprietary and open source code - do you have to apply the open source license terms to the entire combination? This session will provide answers and review legal definitions and practical examples of software combinations that do/don't qualify as "derivative works" under open source licenses and intellectual property laws and shed light on what commercialization activities do/do not involve "distribution," for example in the context of ASP models, outsourcing, intra-group transfers of software. Attendees will also get an overview of legal challenges that can be brought against overreaching licenses terms under U.S. and foreign laws.
